2016-2017 File Portfolio (Incidents and Claims)

During the 2016-2017 Fiscal Year, the Fund managed a portfolio of 42 claims files (26 carried over from 2015-2016, and 16 new claims), and 27 incident files (13 carried over from 2015-2016 and 14 new incidents).

Incident Reports. The Administrator receives oil pollution incident reports from many sources―particularly from the Coast Guard. Some of these incidents are responded to in a satisfactory manner at the local level, when the ship owner or the insurer deals directly with the claims. In such cases, the incident report will not translate into a claim submitted to the Fund at a later date. However, when there is a risk that the incident becomes a claim that is submitted to the Fund, the Administrator will take measures to protect the Fund against the risk that the ship owner may not assume his financial responsibilities or to ensure that the measures taken to mitigate the risk of pollution are reasonable.

Claims Files. The Administrator receives the request for claim, assesses the claim, makes a settlement offer to the claimant and pays the established amount, if the offer is accepted. The Administrator is then subrogated to the rights of the claimant and must take all reasonable measures to recover the amount paid out from the ship owner, the insurer or any other responsible third-party.

The files listed below were dealt with during Fiscal Year 2016-2017 and were reported in the last available corresponding annual report. Files dealt with during Fiscal Year 2017-2018 will be added to the 2017-2018 Annual Report once it is tabled in both Houses of Parliament. In the meantime, here is the list of claims received during 2017-2018 and 2018-2019, as well as the list of closed files for the years 2017-2018 and 2018-2019. Both lists are updated weekly.
